Legal documentation

Requirements for Guatemalan marriages
  • Live or reside within the town and / or within the perimeter of the municipality of Guatemala
  • Birth Certificates of the parties issued by the Civil Registry of the place of birth (not to exceed three months of being issued)
  • Identity cards in good condition, the sheets should not have plastic covering so that changes can be made
  • Clear and legible photocopies of the Identity card of the parties. (In the event that one of the parties was under age, they must submit a clear photocopy of the identity card of the parent or person having custody of the minor, or have authorization duly signed by a notary). All persons above must be present the day of the marriage
  • Medical certificate of both parties establishing that they do not suffer from contagious diseases or incurable physical defects to procreate. (The medical certificate is not necessary, when the parties have lived together and have children). If they already had children of previous relationships, their birth certificate must be submitted
  • Beautification Tax Ticket of Guatemala City (Boleto de Ornato) from both parties
  • If one or both parties are widowed or divorced, they must present a recent birth certificate issued by the Civil Registrar, in which the divorce and / or death has already been recorded
  • Fill the application form which may be collected in the Marriage Office, 2nd. floor of the Municipality from 9 am to 5 pm
  • With all the legal formalities and requirements needed to approve the marriage and the paperwork completed, a date and time to celebrate a civil marriage at the Municipality will be given.
Economic Regime: The spouses may choose from the following
  • Total Community Economic Regime: Joint property of assets before and during marriage; at the moment of separation, everything will be divided in equal parts
  • Separate property of assets: The spouses will keep the properties that were acquired before and during the marriage
  • Community property: The assets acquired by the spouses before marriage, will form a marital property with the exception of those acquired by inheritance. (In case a prenuptial agreement was not drawn up.)
Requirements for Marriages of Foreigners in Guatemala
  • Birth Certificate
  • Certificate of Freedom to Marry
  • Both of the above mentioned documents must be legalized by:
    • Guatemalan Ambassador in the country of origin
    • Ministry of Foreign Affairs in Guatemala
  • Medical certificate from both (groom and bride)
  • Valid Passport
  • Two newspaper proclamation publications
  • The marriage articles must be done trough a public notary, if either one of the parties is foreign and the other Guatemalan
  • All foreign documents should be registered.
